The Institute at the Conference "Law in Digital Age"

On 23 November, the Institute held a roundtable on "Antitrust Regulation in the Digital Age".

Over November 23-24, The Fifth International Scientific and Practical Conference "Law in the Digital Age" was hosted, organised by the Scientific-Instructional Laboratory for Information Law, at the Faculty of Law of the HSE. The conference was aimed at summarising the current practices, identifying the most problematic areas, and the creation of proposals for further development of legislation. The conference was attended by researchers from Russia, Brazil, India, France, Belgium, Italy and Sweden.
 
In the framework of the conference the HSE-Skolkovo Institute for Law and Development on November 23 held a roundtable on "Antitrust Regulation in the Digital Age". Moderator Alexey Ivanov noted that the modern model of competition in the IT sector, characterised by flexibility and constant changes, raises new questions for antitrust regulation. Head of the Analytical Department of the Federal Antimonopoly Service of Russia and leading researcher of the Institute Alexei Sushkevich made a report on the digital economy and the specifics of this segment of the market in antitrust regulation. In particular, Sushkevich noted that traditional antitrust concepts, such as, for example, the boundaries of the market, cause difficulty for the regulator when confronted with the realities of the "new" economy. It is possible to talk about the fact that competition in the "market" is replaced by competition "for the market".
 
Insight in the case of Google in Russia was represented by Roman Krupenin, Head of Legal Practice in Technology, Distribution, Mergers and Acquisitions at "Yandex". Krupenin indicated that due to the nature of the platforms, their owners often occupy a dominant position and can abuse it. The participants also discussed the case of Microsoft. Junior Researcher Niousha Nademi conducted an analysis of the European and American approaches to the resolution of this case.
 
Researcher at the Institute Claudio Lombardi delivered a paper on the relationship between digital identities and information protection and the role of antitrust law in these matters. He also touched on the issue of combating monopolies in the media sphere. Report on this subject was presented by Junior Researcher Elisabetta Mazzeo. 
 
On November 24, Alexey Ivanov also spoke at the session "Modernisation of Management Models for Copyright and Related Rights". Ivanov: "In the analysis of legal instruments, regulators should consider whether such instruments function. A purpose of intellectual property law is to stimulate the creation and increase of new knowledge. Instruments that balance the interests of different social groups can further antitrust regulation. At present, however, intellectual property is unnaturally excluded from antitrust regulation in Russia".
