Institute Representation at the International Conference "Protection of Personal Data"

Leading Researcher at the Institute Elena Voinikanis delivered the presentation "The role and importance of self-regulation in the field of personal data protection. 

The international conference "Protection of personal data" was held on November 8 at the Rossiya Segodnya International News Agency. Organised with the support of Roskomnadzor (Federal Supervision Agency for Information Technologies and Communications) as an annual event, current issues related to personal data were discussed.


"In Russia, in the field of personal data protection, there is no legislatively fixed mechanism for self-regulation, but this sphere is developing, the best practices are accumulating, primarily through industry initiatives", said Elena Voinikanis. The most striking example, in her opinion, is the system of standards for the protection of personal data at the Central Bank of Russia. The initiative, according to Voynikanis, was based at the Central Bank, then banking associations joined in the development of standards, and an ad hoc committee on standardisation was established. Today, this system being practically exemplary, other industries now aim to match it.


Elena noted the enterprising position of Roskomnadzor in the development of self-regulation in the field of protection of personal data. Indeed, in 2016, the department developed their Strategy for the Protection of Personal Data Towards 2020. In it, the introduction of self-regulatory mechanisms is considered as one of the conditions for the development of a system of behavioral practices aimed at compliance with the requirements of Russian Federation legislation in the field of protection of personal data. The strategy provides for certain forms of self-regulation; through the participation of personal data operators in the work of consulting and advisory structures, and through the development of feedback mechanisms.


"I want to say that this Strategy is being implemented in practice. Already in the year of its adoption, within the framework of the Advisory Council under Roskomnadzor, an ad hoc working group was established to develop sectoral codes of conduct. There is more than half a year of the joint work of experts, regulators and specialists of the department, and it continues, as a result of which there have been Methodical Recommendations for the development for a sectoral code of conduct in the field of protecting the rights of subjects of personal data", Elena Voinikanis said.


The speaker also stated that the draft recommendations were recently sent out to the regulatory community, and after discussion, they will be finalised.
